2. Processing DMCA Notices

Upon receiving a valid DMCA notice, we will:

  • Review the claim to ensure it meets DMCA requirements.
  • Remove or disable access to the allegedly infringing content.
  • Notify the user who posted the content about the takedown and provide them with a copy of the DMCA notice.

3. Filing a Counter-Notice

If you believe the content removed is not infringing, you may file a counter-notice. Your counter-notice must include:

  1. Your Contact Information:
    • Full name
    • Email address
    • Physical address
    • Phone number
  2. Identification of Removed Content:
    • Describe the material that was removed and where it appeared before takedown.
  3. Good Faith Statement:
    • A statement, under penalty of perjury, that you have a good faith belief that the content was removed in error or due to misidentification.
  4. Consent to Jurisdiction:
    • A statement that you consent to the jurisdiction of your local federal court or, if outside the United States, to the jurisdiction of the courts where Ndivo is located.
  5. Signature:
    • A physical or electronic signature.

4. Repeat Infringers

Ndivo reserves the right to terminate access to users who are found to be repeat infringers of copyright law.
